In the European Union (EU), legal criteria (legal criteria) apply to buy buttons. These legal criteria serve to protect the customer and include requirements for the display and behavior of the buy button on the order form. They also protect you from increased complaints and administrative burden.
Due to the reseller model, the sale of your products takes place via the Digistore24 order form. Digistore24 checks during the purchase process whether the EU legal criteria apply and adjusts the buy button accordingly.

Sales conditions
The EU legal criteria apply when selling to private customers (business to customer), not to commercial customers (business to business). An order is considered commercial if the buyer acts as an entrepreneur.
EU legal criteria apply:

When selling to private customers, if the seller is based in the EU. This applies regardless of the location of the customer.

EU legal criteria for buy button
- The buy button must be clearly labeled and must clearly indicate that a legally binding purchase contract, which entails a payment obligation, will be concluded by clicking it.
- The buy button must be in close proximity to and in a visually clear relationship with the statutory mandatory information.
- The mandatory information must list the individual purchase items included (e.g., main product and add-on) and their individual prices.

This behavior is a function required under EU law that ensures buyers can always clearly see which product they are purchasing before they make a binding payment. Depending on whether the product name is visible, the order form adapts automatically.
To make this more transparent for you, here is a compact overview of the behavior and how you can configure it yourself.
On EU order forms, the following applies: Users must never see only the buy button without at the same time being able to see which product they are purchasing.
This is why the following happens:

When the product name is visible:
- the buy button directly starts the payment process
- no additional pop-up appears, because the legal requirement is fulfilled

When the product name is no longer visible while scrolling:
- the buy button changes its label (e.g. to “Complete order”)
- when clicked, an order pop-up opens that again shows what is being purchased
- the final “Buy now” button is located in the pop-up
This automatic switching may feel unusual to many users at first, but it is fully intentional and serves to ensure legal compliance.
When the product name is visible, the order summary above the buy button is hidden in order to avoid duplication.
As soon as the user scrolls and the product name is no longer visible, the order summary reappears so that it always remains clear which product is being purchased.
This is also not an error, but a deliberately built-in mechanism to comply with EU requirements.
How you can configure this behavior yourself:
- In the Vendor view, open Account > Order forms.
- Create a new order form or click the pencil icon on an existing order form to open it for editing.
- On the Buy button component, click the gear icon.
- In the sidebar, switch to the Advanced tab.
- Under Show order summary, select one of the following options:

An order pop-up appears when the product name is not visible.

The order summary is displayed directly above the buy button when the product name is not visible.

The order summary is permanently displayed, regardless of whether the product name is visible. If you choose this option, the “jumping” or “disappearing” of the order summary stops.
