Legal criteria apply to upsell pages in the European Union (EU). These legal criteria serve to protect customers and include specifications for how upsell pages and buy decision buttons are to be displayed and behave. They also protect you from a higher volume of complaints and administration. Digistore24 checks whether the EU legal criteria apply during the purchase process on the upsell page. This way, you can offer legally secure upsells as a vendor.

Sales conditions
The EU legal criteria apply to sales to private customers (business to customer), not to commercial customers (business to business). A customer is regarded as commercial if the order form asks for the company address and they provide it.
EU legal criteria apply:
- For sales to private customers if the seller is located in the EU. This applies regardless of the customer's location.

- For sales to commercial customers. This applies regardless of the location of the seller or customer.
- For sales to private customers if the seller and customer are both located outside the EU.

EU legal criteria for upsell pages
- The upsell page must clearly show what product is available for purchase.
- The upsell page must clearly show the product price and what additional costs will be incurred, e.g. shipping costs.
- The upsell page must clearly indicate which payment plan will be used to make the payment.
- A discounted price may only be displayed on the upsell page if the discounted price is stored as a payment plan in the product.
- The upsell page must clearly indicate which legal conditions apply to the purchase.
- The upsell page must clearly display the above information in close proximity to the buy button so that the customer understands the connection.
- The upsell page must not suggest that the previous purchase has not yet been completed or is going to be subsequently upgraded, e.g. by displaying a progress bar or wording such as "Your order is not yet complete".
- The buy button must not suggest that the previous purchase has not yet been completed or is going to be subsequently upgraded, e.g. with wording such as "Add to order".
- The buy button must not be misleading with respect to the payment plan, e.g. by using wording such as "Secure gift" for a paid product.
Note

If you use your own buy buttons, use formulations such as "Yes, I would like to buy the product" or "Yes, I would like to have the product". The contract is then automatically concluded via our legally secure upsell buy button.
