Cookie banner for privacy compliant tracking

A cookie banner is a text field that is displayed on a website and requests the site visitor's consent to the processing of personal data.

If you want to track visitors to Digistore24 order forms for your products, Digistore24 will display a cookie banner under certain conditions.

Legal provisions

The legal provisions on cookie banners for tracking codes arise from the European General Data Protection Regulation (GDPR, Article 6, paragraph 1) as well as from the confirmatory judgments of the European Court of Justice (ECJ 01.10.2019) and the Federal Court of Justice (BGH 28.05.2020).

As such, a website must inform its visitors and ask for consent if it collects data that is not essential. This includes personal and behavior data that the website collects using tracking methods.

The following therefore applies to Digistore24:

  • If tracking is used on the order form or the order confirmation page, a cookie banner must be displayed under certain conditions when the order form is accessed, allowing the site visitor to consent to the use of their data.

  • The cookie banner must offer the option of manually providing consent. The site visitor must have the option of deliberately agreeing to the consent or deliberately rejecting it.

As consent is not required for collecting essential data, the cookie banner on the Digistore24 order form only asks for consent for non-essential data.

Cookie banner is displayed

If all of the following conditions are met, the cookie banner will be displayed:

  1. The sale is made via Digistore24 GmbH or the site visitor is located in Germany.

  2. You have set up tracking on the order form and/or on the order confirmation page.

  3. You have enabled cookie banners to be displayed for tracking on the order form.

Tracking is activated

If these conditions are met, tracking is activated on the order form:

  • The buyer agrees to tracking or has already granted their consent earlier, e.g. on the Digistore24 homepage or for another product.

  • The sale is made via Digistore24 Inc. and the site visitor is located outside the EU.

Examples

  • For customers from Germany, order form tracking is only activated if consent has been granted, regardless of which reseller is used for the sale.

  • For US customers via Digistore24 Inc., order form tracking is activated without the cookie banner.

Hide cookie banner

If customers reach the order form via your website, you can obtain consent for tracking via your cookie banner. In this case, no cookie banner will be displayed on the Digistore24 order form, as the request for consent has already been made.
