Special approvals for physical and digital products

Good to know

This information refers to selling products through Digistore GmbH. If you would like to sell your products through the reseller Digistore24 Inc., please follow these approval criteria.

Attention

The approval criteria also apply in addition to the regular approval criteria.

If you as a vendor want to sell the products mentioned below via the reseller Digistore24 GmbH, we need to grant you special approval:

The reason for this is that we are obliged to check further documents for tax reasons (e.g., in case of a reduced VAT rate) and legal reasons (e.g., the marketability of food supplements). Please take into account the following criteria before requesting approval for your product.

1. USB sticks

In order to sell USB sticks via the reseller Digistore24 GmbH, the USB stick must have a CE marking. This marking should be clearly visible on the USB stick or on the packaging. With the CE marking, the manufacturer (vendor) declares, in accordance with EU Regulation 765/2008, that they shall assume responsibility for the product's conformity with all applicable requirements.

Please also take into account the following requirements:

  • If you place an image of your USB stick on your sales page, make sure that the CE marking is clearly visible.

  • If you don't have any images of your USB stick on your sales page, please email us an image of the USB stick with the CE marking clearly visible (make sure you also include the product ID).

You can send us these documents by email to: genehmigung@digistore24.com.

Attention

Without the CE marking, you'll not be allowed to sell your USB stick.

2. Food supplements

If you want to sell food supplements via the reseller Digistore24 GmbH, we need separate documents from you.

These are:

  • Proof that the product has been registered with the Federal Office of Consumer Protection and Food Safety in Germany.

  • A certificate of marketability. In other words, a certificate recognized by an authorized, external and independent laboratory stating the product complies with all food regulations in Germany.

3. Printed books, e-books and audiobooks on CD or available as a download

Printed books, e-books and audiobooks on CD are sold at a reduced VAT rate of 7%. For tax reasons, we have to check these products and the corresponding product type:

  • Printed book = book in physical form delivered by post.

  • E-book = digital product. Displays a book in digital form. Usually delivered as a PDF file.

  • Audiobook on CD = book in audio form delivered as a CD.

  • Audiobook for download = book in audio form delivered as MP3 audio file.

In order for us to review these products, please make sure the following is present on your sales page and/or order form:

  • An image of your printed book/e-book/audiobook on CD

  • Or text indicating that the product is a printed book/e-book/audiobook on CD/audiobook for download.

In addition, it's mandatory that shipping takes place from Germany for sales via the reseller Digistore24 GmbH. Please state this on your sales page, order form, and legal notice.

Attention

If a country other than Germany is listed on the legal notice, and no other shipping details are given (e.g., "Shipping from Germany"), we will reject the product with the rejection reason "Shipping country unclear".

4. Educational seminars in Switzerland

Educational seminars in Switzerland are tax-exempt. For this, we need proof from you as a vendor that your seminar is an educational seminar that can be sold tax-free. This means that we need an official letter/confirmation from the respective tax office that this is the case. You can get the certificate from your local tax office in your canton. Please send it to genehmigung@digistore24.com.

5. Special approval for distance learning products with learning assessments

Distance learning products, such as online courses, where, for example, after course completion:

  • A certificate is issued

  • An exam is taken

  • Oral or written assessments of learning progress take place

  • Any kind of tests, answering and preparation of questions, etc. take place

fall under the Distance Learning Protection Act (FernUSG) in Germany. This law states that providers of distance learning must be certified by the Central Office for Distance Learning. For more information, please visit: www.zfu.de. If your product falls under the FernUSG, please submit your certification to genehmigung@digistore24.com. Your product cannot be approved without this documentation.

Good to know

This law applies to Germany. It therefore refers to the place of performance, but also to the fact that the product could be purchased by a customer who is located in Germany. The address in your legal notice, the language of your product, and your place of business are not relevant.
